One Dev Future Teams is part of One Developer LLC, with a legal address at 1212 Via Di Salerno, Pleasanton, CA 94566 US (“One Dev Future Teams” or “we”). We engage in software development and publishing, and for the good and valuable consideration described herein, we provide you (“you” or “user”) with proprietary or licensed digital content: games and other interactive and/or entertainment content accessible through various platforms, including app stores, social networks, standalone websites, downloadable client software, any corresponding updates, and any virtual items you purchase within our software (collectively referred to as our “Games”).

Section 1: Acceptance of Terms and Conditions

Accepting these Terms and Conditions (“Terms”) establishes a binding agreement (“Agreement”) between you and One Dev Future Teams and governs the use of our Games and other services (such as forums and support systems) (collectively referred to as our “Services”).

By downloading the application or game client, accessing our Games through a website or social network, or registering in our system, you accept these Terms and our Privacy Policy, which is incorporated herein by reference. Your relationship with One Dev Future Teams will be governed solely by these Terms and our Privacy Policy.

We may also enter into binding agreements with parties other than users, but such agreements are for the benefit of users (third-party beneficiary contracts). This provision applies when a payer wishes to purchase virtual items for a user. In this case, only the user can claim the corresponding consideration from us.

App stores and platforms may provide their own legal documents applicable to your relationship with those stores and platforms.

You represent that you are at least 13 years of age. If you do not meet the age requirement, you may only play our Games with the proper consent of a parent or legal guardian (who is also bound by these Terms). Additionally, we may request sufficient evidence of such consent at any time.

Please read the Privacy Policy and these Terms carefully before you begin using our Games. For example, Section 4 here contains important information about your withdrawal rights.

One Dev Future Teams reserves the right to modify these Terms and the Privacy Policy at any time and may impose new or additional terms and conditions on your participation in our Games. You should regularly check this webpage for new versions. You may object to any changes within two weeks of their publication by contacting our support team (for more details on how to contact us, see Section 3). If you do not raise an objection within two weeks, you are deemed to have accepted the changes. If you object within two weeks, we may terminate our Agreement with you under Section 6 of this Agreement.

Section 2: Ownership and License

One Dev Future Teams hereby grants you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to access our Games and download and install client mobile and desktop applications for that purpose, solely for your non-commercial entertainment use, provided that you comply with these Terms. Your license does not grant you ownership or title to the Games; they are licensed to you, not sold to you. Your license to access each Game is contingent upon your prior acceptance of these Terms and compliance with Section 5 - Acceptable Use Policy. Except as expressly permitted by these Terms, you may not copy any part of the Services in any form or by any means. You agree not to modify, rent, lease, lend, sell, distribute, publicly perform or display, transmit, or otherwise exploit, adapt, or publish the Games in any way. Any such attempts infringe the intellectual property and other rights of One Dev Future Teams and its licensors. You may not use our trademarks or any and all game content other than our Games, including but not limited to artwork, music, commercial appearance, or user-generated content from others, without our prior written consent. The above license grant will automatically terminate when you no longer meet any of the above conditions.

You may not copy (unless expressly permitted by these Terms), decompile, reverse engineer, disassemble, attempt to obtain the source code of the Games, modify, or create derivative works based on our Games, any updates, or any part thereof (unless and only to the extent applicable law prohibits any of the above restrictions).

Any use of the Games or any related parts beyond the permitted use herein is strictly prohibited and will infringe our intellectual property rights, potentially exposing you to civil and criminal penalties, including possible monetary damages. The rights to trademarks, Games, and all related content are owned by their respective owners and protected by Lithuanian and international copyright, design, patent, and trademark laws, international treaties, and other laws protecting intellectual property and related proprietary rights. You may not copy or download any content from our Services without our explicit authorization. You may not remove, obscure, or alter any copyright, patent, trademark, or other proprietary rights notices accompanying the Services.

Section 3: Games and Participation

You can find information about our Games on our website, app stores, and other platforms, including features, gameplay, functionality, and system requirements. We continuously develop our Services based on user interest, and therefore we may replace, add, exclude, change, or modify our Games and their features at any time. Our Games are intended for use in their current valid versions, and One Dev Future Teams has no obligation to continue supporting or updating non-latest versions of the Games.

Important Note: You explicitly agree and acknowledge that you are responsible for any internet connection fees incurred while using our Services. Your in-game purchases may incur third-party transaction fees: please refer to the rules of your selected payment service provider at that time.

You may contact our support team at any time through our website (using this link) or by emailing [email protected]. We currently do not provide phone support.

We are committed to enhancing your experience and may add new features and content in the Games or remove existing features and content, but we will do so only considering and balancing user interests. For reasons including but not limited to system security, stability, and multiplayer interoperability, we may need to update, create new versions, or otherwise enhance the Games; therefore, the system requirements for participating in the Games may change over time. You agree to such automatic updates.

You understand that various technologies introduced by One Dev Future Teams may not necessarily be consistent across all platforms, and the performance of our Games may vary depending on your computer and other devices.

If your Game is linked to your user account on any platform (e.g., Google Play, Apple Game Center) and you lose access to that platform or encounter any other user (email) account issues, please contact the customer service of the respective platform or email provider. We cannot change the platform user account associated with your Game.

Maintenance may affect the availability of our Games, and we will only perform maintenance after fully considering user interests. Downtime may also result from technical issues beyond our control.

Our Games are free, but you can enhance your gaming experience and progress by purchasing virtual items and virtual currency (“Virtual Items”) with real money. Payment methods may vary depending on which app store or platform you make purchases from. Without affecting Section 4 below, Virtual Items are not redeemable for real money or refundable. You understand that you do not own Virtual Items but have obtained a limited license to use Virtual Items according to specific gameplay; therefore, your rights to use any Virtual Items are subject to these Terms. Unless the description of Virtual Items specifies a particular minimum usage period, you have no right to use Virtual Items for a minimum time.

You agree that One Dev Future Teams reserves the right to manage, regulate, control, modify, and/or eliminate game elements for gameplay and multiplayer balance purposes (these rights may include but are not limited to significantly enhancing or diminishing the value, effectiveness, or function of Virtual Items, making them more or less common, or even completely eliminating them). All Virtual Items remain our property.

You acknowledge that our Games may contain information about our other products or services or special offers. This information constitutes a part of our Games.

Games may contain advertisements for third-party products and services. One Dev Future Teams is not responsible for such advertising content that does not belong to our Games. If you wish to opt out of receiving and/or viewing advertisements, you can notify One Dev Future Teams by emailing [email protected].

Section 4: Withdrawal Rights

Some online app stores provide options to withdraw from purchases made in that app store without providing any reason. Such refund policies may be published in the terms of use of the respective app store. If you request a refund from an app store and receive a refund for our in-game purchases, we reserve the following rights:

To deduct the virtual currency purchased with the refunded amount from your user account or any items purchased with that virtual currency, or items purchased and refunded;

To suspend your user account/game access/game features if such refunds occur frequently and/or for fraudulent purposes, and/or if the virtual currency balance becomes negative.

We may notify you regarding the withdrawal of Virtual Items.

For residents of EU member states only: If you are located in an EU member state, you have the right to withdraw from any goods purchased from us without reason within 14 days. The withdrawal period expires 14 days after the purchase date.

Section 5: Acceptable Use Policy

User-Generated Content (UGC) Policy

You may not submit user-generated content that is: (i) offensive, illegal, obscene, defamatory, slanderous, threatening, abusive, inappropriate, pornographic, harassing, hateful, or otherwise illegal or violating any law; (ii) fraudulent or misleading; (iii) protected by any applicable copyright law, infringing trade secrets, or otherwise infringing any person's privacy, property rights, or any other rights; (iv) soliciting advertisements or business, funds, products, or services; or (v) impersonating others or invading any third party's privacy. We reserve the right (but have no obligation) to determine whether any user-generated content (UGC) you use complies with these Terms and may at our discretion delete such UGC, suspend and/or terminate the Agreement with the relevant user.

One Dev Future Teams has no obligation or ability to pre-screen user-generated content (UGC) and does not guarantee the accuracy, quality, or completeness of any UGC communicated through the Services. By using the Services, you acknowledge and accept that you may be exposed to content that you find offensive or objectionable.

Communication Channels Policy

The Services may provide communication channels such as forums, communities, or chat areas designed for you to communicate with others. One Dev Future Teams has no obligation to monitor these communication channels but may do so and reserves the right to review and delete any materials posted on these communication channels at any time, for any reason, at its sole discretion. One Dev Future Teams may also terminate or suspend your access to any channel at any time without notice for any reason, including but not limited to complaints from other users about your use of obscene language or posting materials containing threats or abusive content. You acknowledge that chats, posts, or materials posted by users on the channels are not endorsed or controlled by One Dev Future Teams and such communications should not be construed as having been reviewed or approved by One Dev Future Teams. One Dev Future Teams is not responsible for any activities within the communication channels under any circumstances, and these channels are public, so you should not expect privacy when using them. One Dev Future Teams is not responsible for any information you choose to share in communication channels.

Game Policy

You agree to use the Services legally and comply with the usage rules. To further clarify the above, you agree not to use the Services for the following purposes:

Posting, uploading, transmitting, or otherwise disseminating obscene, vulgar, profane, pornographic, sexual, or otherwise offensive material;

Defaming, slandering, mocking, ridiculing, stalking, threatening, harassing, intimidating, or abusing anyone in a hateful, racial, ethnic, or otherwise offensive manner;

Uploading or transmitting (or attempting to upload or transmit) files containing viruses, Trojans, worms, time bombs, cancelbots, corrupted files, or data, or any other similar software or programs that may damage the Services or the operation of other users' computers;

Infringing any party's contractual, personal, intellectual property, or other rights, including using, uploading, transmitting, distributing, or otherwise providing any information provided through the Services in a manner that infringes any party's copyright, trademark, patent, trade secret, or other rights (including privacy or publicity rights);

Attempting to obtain another person's password or other private information;

Improperly using support channels or complaint buttons to make false reports to One Dev Future Teams;

Developing, distributing, or publicly informing other users of “automated” software programs, “macro” software programs, or other “cheat utility” software programs or applications;

Exploiting, disseminating, or publicly informing others of any game bugs, errors, or vulnerabilities to gain unintended advantages;

Attempting to interfere with, decrypt, or disrupt any transmissions to or from One Dev Future Teams or compromise or damage One Dev Future Teams' servers;

Using the Services or any part thereof to perform in-game services, such as leveling and item collection services, in exchange for any compensation;

Promoting the intention or act of buying, selling, trading, sharing, or transferring access to your user account or Virtual Items to any third party, unless expressly authorized by One Dev Future Teams;

Transmitting unauthorized communications through the Services, including spam, chain letters, junk messages, and any materials promoting malware, spyware, and downloadable items;

Engaging in any fraudulent/illegal activities that may result in false payments within the Services, such as obtaining any advantages and/or Virtual Items without actual payment;

Transmitting, providing, or otherwise promoting or supporting cheating, hacking, cracking, malware, viruses, or any other computer code, files, or programs designed to modify, damage, destroy, interfere with, alter, or limit the functionality of the Games or any part thereof, control any computer software, hardware, or telecommunications equipment, or interrupt any user's uninterrupted use and enjoyment of our Games;

Engaging in any fraudulent/illegal activities that may result in changes to the functionality and parameters of the Services or any part thereof, including restoring used advantages and/or obtaining additional advantages, including advantages obtained without payment;

Creating any user accounts through automated means or false pretenses, creating multiple accounts on each device, or using any other user account for any purpose, including evading suspensions or bans;

Making any time changes (i.e., changing the time zone on the device, changing the device time by 2 days or more), which may result in obtaining additional advantages or extending the duration of advantages in the game;

Violating any provisions of the Game Rules (if any);

Violating any applicable laws or regulations or promoting or encouraging any illegal activities, including but not limited to hacking, cracking, or distributing counterfeit software or game cheating or hacking.

Game Rules and Penalties

Any in-game rules, policies, and restrictions (if any) (“Game Rules”) constitute a part of these Terms.

You agree to comply with the Game Rules while using the Services. You hereby agree that violations of the Game Rules may result in penalties imposed by One Dev Future Teams, including but not limited to:

In-game penalties that do not involve suspensions;

Temporary and/or permanent in-game suspensions (chat/forum suspensions; suspensions of specific in-game features, etc.). You acknowledge that such suspensions do not constitute a suspension of your user account or game access, nor will they affect your gaming experience;

Suspension of user accounts/game access; and

Suspension of game access on specific user devices.

In-game penalties are implemented based on the Game Rules, depending on the nature, scope, and frequency of the user's violation of the Game Rules. A user's violation of the Game Rules constitutes a material breach of these Terms.

Naming Policy

The nicknames, team names, and other items or entities that users use or create in the game must not:

Contain obscene, vulgar, explicit sexual content, offensive content, harmful content, content involving sexual acts, inappropriate references to human anatomy or bodily functions;

Promote drugs, blasphemy, anti-gay, ethnic, racial, or sexual offense, or spread any real-world hostility toward specific nationalities, races, or religions; any name must not mention any sexual orientation related to oneself or other users under any circumstances;

Violate any applicable laws;

Infringe on any third party's intellectual property and/or geographic indications;

Advocate for extremist and terrorist activities or defend similar activities, or draw attention to the needs of extremist and terrorist organizations, groups, and individuals;

Contain statements or information that disparage or offend public officials and/or any national symbols;

Include serial numbers, usernames, passwords, and other means of unauthorized access to chargeable resources on the internet;

Contain statements or information that may represent the disclosure of national or official secrets or other confidential information;

Contain threatening, vulgar, defamatory statements and suggestions that conflict with accepted moral standards, and improperly use third-party personal information (including but not limited to mentioning any address, phone number, or any other personal contact information without third-party consent);

Consist solely of numbers, geographical names, political parties, well-known titles, and names;

Reflect, glorify, or imitate any real-world groups or organizations, historical events, sports teams, terrorist organizations, criminals, discriminatory organizations, or other communities with negative connotations or related to crimes against humanity, based on nationality, gender, or religious principles, or their leaders and puppets (this includes using the names of real-world military, political, or religious groups or figures);

Use the character names of other players to impersonate their identity.

Section 6: Termination and Cancellation

The Agreement between One Dev Future Teams and the user is valid indefinitely. Either party may terminate this Agreement at any time by providing 14 days' prior notice (in writing or via email). You may also terminate this Agreement immediately by deleting the Game from your device or social network application.

Either party may terminate this Agreement for cause without notice. Grounds for such termination include a material breach of these Terms. If a user fails to comply with any provision of these Terms, or if One Dev Future Teams has reasonable grounds to believe that the user has failed to comply with any provision of these Terms, One Dev Future Teams may, without notice: (i) terminate the Agreement with the user and delete their account, with the user remaining liable for all payments due under their account as of the termination date (including the termination date); and/or (ii) restrict the user's access to the Services (or any part thereof); (iii) suspend the user's account/game access and/or game support services until the breach is remedied.

One Dev Future Teams reserves the right to modify, suspend, or terminate the Services (or any part thereof) at any time and shall not be liable to the user or any third party in exercising such rights.

Section 7: Use of Technical Data

You agree that One Dev Future Teams may collect and use technical data and related information, including but not limited to technical information about your device, system, and application software, and peripherals. This information may be collected periodically to provide you with software updates, product support, and other services (if any) related to the Games. One Dev Future Teams may use this information to improve its products or provide you with services, provided that this information does not exist in a form that personally identifies you.

Information collected from users is subject to the applicable policies of the social networks or app stores in effect at the time. By using the Services, you authorize the social networks or app stores to share your email address and any other personal identification information with One Dev Future Teams. We are committed to respecting your privacy and keeping your personal information confidential. We will process your personal information in accordance with our Privacy Policy. Please read it carefully before you start using our Services.

Section 8: Disclaimer and Limitation of Liability

To the maximum extent permitted by law: the Services are provided "as is," and you use them at your own risk, without any warranties. One Dev Future Teams will provide the Services with reasonable care and skill but makes no other commitments or guarantees regarding the Services, particularly does not guarantee, represent, or warrant and expressly disclaims all such warranties of any kind related to the Services, whether express, implied, or statutory, including but not limited to warranties or conditions of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. One Dev Future Teams further does not represent or warrant that the Services will always be available, accessible, uninterrupted, timely, secure, accurate, complete, and error-free, or that they will run without data packet loss.

Nothing in these Terms excludes liability for damages caused by intentional misconduct or gross negligence. These Terms do not exclude or limit liability for harm to a user's health, loss of life, or non-monetary damages.

You agree to indemnify and hold One Dev Future Teams and its affiliates, subsidiaries, directors, officers, agents, contractors, partners, and employees harmless from any losses, liabilities, claims, demands, damages, costs, and expenses (including reasonable attorney fees) arising from or related to: (i) your use of and access to the Services in violation of any of these Terms; (ii) your infringement of any third-party rights, including but not limited to any copyright, property, or privacy rights; (iii) any UGC you transmit through the Services.

If we are unable to provide the Services due to force majeure, we will not be in breach of any of our obligations to you under these Terms.

Section 9: Governing Law and Dispute Resolution

These Terms and all relationships between One Dev Future Teams and users arising therefrom are governed by Lithuanian law, excluding the United Nations Convention on Contracts for the International Sale of Goods and without regard to principles of conflict of laws. If the user’s habitual residence is in another EU member state at the time of entering into the agreement with One Dev Future Teams, the mandatory provisions of that country shall apply.

To expedite the resolution of any disputes, controversies, or claims related to these Terms or any policies, documents, or agreements contained herein (“Dispute”) and to reduce costs, you and One Dev Future Teams agree to attempt to negotiate informally any Dispute arising from or related to the Dispute for at least thirty (30) calendar days before initiating any arbitration, online dispute resolution, or court proceedings, whether based on contract, tort, fraudulent misrepresentation, statute, regulation, common law, equity, or any other legal basis.

Negotiations commence upon receipt of written notice from the disputing party. One Dev Future Teams will send the notice to your billing address and/or forward a copy to the email address you provided to us (if any).

If the Dispute cannot be resolved through negotiation, you agree that any and all Disputes arising from or related to the Games or Services shall be resolved individually without resorting to any form of class action and agree to submit to the exclusive jurisdiction and venue of the appropriate courts located in the United States, unless otherwise provided by applicable law.

Section 10: General Provisions

These Terms, along with our Privacy Policy and Game Rules, constitute the entire agreement between you and One Dev Future Teams regarding your use of the Services.

You may not assign these Terms or any of the rights or obligations contained herein. One Dev Future Teams may assign these Terms or any of the rights or obligations contained herein to any third party without prior notice.

If any provision of these Terms is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.

The failure of One Dev Future Teams to exercise or delay in exercising any lawful right or remedy under these Terms or applicable law shall not constitute a waiver of such rights or remedies.

You acknowledge and agree that you have read these Terms and understand all rights, obligations, terms, and conditions contained herein. By clicking the "Accept" button and/or continuing to use the Services, you expressly agree to be bound by these Terms and grant One Dev Future Teams the rights set forth herein.
